What the buyer wrote

The subject requirement is being procured using the Alternative Competition Method in accordance with the Patent and Trademark Office Acquisition Guidelines (PTAG), 78 Fed. Reg. 61185 (October 3, 2013), and the Patent and Trademark Office Efficiency Act (PTOEA) 35 U.S.C. § 2(b)(4)(A).

As a result of its exemptions, the USPTO is not required to meet the test of “full and open competition” as defined in FAR Part 6 and may use agency-specific acquisition procedures as described below when the circumstances warrant it and it is in the best interest of the agency to do so.

Consequently, USPTO intends to make a sole source BPA Award to support its portfolio-wide real property planning as well as specific GSA consultation support for pending GSA space assignment actions across the USPTO portfolio.  After previously posting an RFI (ACQ-27-0182) to sam.gov which closed on 9/24/26, USPTO received 2 legitimate small business responses and have identified FD Stonewater, LLC (FDS); 1001 N. 19th Street, Suite 1401, Arlington, VA 22209; UEI:L26UHZU1XC37 as the contractor able to most likely meet the agency’s needs for this requirement.

As a result, per (PTOEA) 35 U.S.C. 2(b)(4)(A  as further defined in PTAG 6.1.1 (d) USPTO intends to negotiate and award a firm fixed BPA with FDS  to meet this requirement.

This notice of intent is not a request for competitive proposals, nor will solicitation be issued to the public. The federal government buys real estate agent and broker services primarily through W2SD ENDIST BALTIMORE, which has placed over 7,000 awards since 2001. The Department of Justice, HUD, and the Office of Construction and Facilities Management are also significant buyers. Most awards go to unrestricted vendors, though the SBA set-aside program accounts for 827 awards. Buying patterns show no active notices currently posted, suggesting most procurement happens through existing contracts or task orders rather than new competitive solicitations.

The median award of $14.4K indicates these are typically smaller engagements, though the total contract value across 32,903 awards reached $2.76B over 26 years. Only 207 distinct vendors have won awards in this category, which suggests moderate competition and potential barriers to entry. Firms should note that the top buyer alone accounts for roughly 11 percent of all awards and 11 percent of total spending, making that relationship a significant factor in market dynamics.

Watch for the 108 contracts worth $71.53M that are ending within the next 12 months. These represent immediate recompete opportunities. The absence of active notices suggests that agencies may be preparing to release new solicitations or extend existing vehicles. Firms not currently on contract should monitor GSA Schedule offerings and agency-specific procurement channels, as the low volume of active notices indicates buying may shift to new vehicles or direct awards in the coming year.
